Terms of Service – WavBeat.com
- General Provisions
- These Terms of Service set out the rules for using the website available at wavbeat.com (hereinafter referred to as the “Service”).
- The Service is operated by Michał Koralewski, ul. Wolności 10/4, 41-800 Zabrze, Poland, e-mail: contact@wavbeat.com (hereinafter referred to as the “Administrator”).
- These Terms constitute the rules for the provision of electronic services within the meaning of the Polish Act of 18 July 2002 on the provision of electronic services.
- By using the Service, the User accepts these Terms of Service.
- User Account
- Creating a user account is required to access the Service.
- Registration requires providing true and up-to-date information and accepting these Terms.
- The User is responsible for keeping their login credentials secure and must not share them with third parties.
- Subscription and Payments
- Access to files in the Service is provided under an annual subscription model.
- The subscription fee is 29.99 EUR per year and must be paid in advance via the payment operator Stripe.
- The subscription becomes active upon confirmation of payment and remains valid for 12 months.
- The User may cancel the subscription at any time; however, subscription fees are non-refundable.
- Right of Withdrawal
- Consumers who conclude a distance contract generally have the right to withdraw from it within 14 days of conclusion.
- This right does not apply where the User begins using the Service, in particular by downloading any WAV file. By starting to use the Service, the User acknowledges and agrees that they lose the right of withdrawal.
- Access to Files and Licenses
- An active subscription entitles the User to download all WAV files available in the Service’s catalog.
- Each file is subject to the license terms available on the download page.
- The User agrees to use the files strictly in accordance with the applicable license terms.
- Rules of Use
- The User must use the Service in compliance with applicable law, these Terms, and good practices.
- The following is strictly prohibited:
a) sharing an account with third parties,
b) attempting to bypass or interfere with the Service’s security measures,
c) reselling or redistributing downloaded WAV files as standalone works. - Liability of the Administrator
- The Administrator makes every effort to ensure that the Service operates properly and continuously.
- The Administrator reserves the right to temporarily suspend access to the Service for technical reasons or due to circumstances beyond their control.
- The Administrator is not liable for the manner in which Users use the files, particularly for any violations of license terms or third-party rights.
- Governing Law and Dispute Resolution
- These Terms are governed by the laws of Poland.
- Any disputes arising from the use of the Service shall be resolved by the competent court having jurisdiction over the Administrator’s registered office.
